ANALYSIS OF THE APPLICATION OF WAKALAH BIL UJRAH CONTRACT ON THE PURCHASE OF FOREIGN GOODS ACCORDING TO DSN-MUI FATWA NUMBER 113/DSN-MUI/IX/2017

The growth of cross-border buying and selling activities through intermediaries, such as deposit services and foreign goods purchasing services, creates a demand for legal certainty, especially from the perspective of Islamic economic law. One of the most commonly used contract categories in this practice is the wakalah bil ujrah contract, which is a contract of delegation of authority with a specific reward. The purpose of this research is to evaluate the application of the wakalah bil ujrah contract in the purchase of foreign goods based on the Fatwa of the National Sharia Council of the Indonesian Ulema Council (DSN-MUI) Number 113/DSN-MUI/IX/2017. This research adopts a qualitative approach with a literature research type. The data sources come from primary legal materials, namely the DSN-MUI Fatwa Number 113/DSN-MUI/IX/2017, supplemented by secondary legal materials consisting of muamalah fiqh literature and accredited scientific journals, as well as tertiary legal materials as complements. Data analysis is conducted through descriptive-analytical methods with a normative-conceptual approach to evaluate the conformity of foreign goods purchasing practices with the provisions of the wakalah bil ujrah contract according to Islamic economic law. The research results indicate that the practice of purchasing foreign goods through intermediary services is essentially permitted and relevant to use the wakalah bil ujrah contract, as long as it meets the pillars and conditions of the contract as regulated in the DSN-MUI Fatwa Number 113/DSN-MUI/IX/2017. However, in practice, there are still potential inconsistencies found, particularly related to the lack of clarity in separating the price of goods and ujrah, the lack of transparency in additional costs, and the ambiguity of the representative's responsibilities. Therefore, the application of the wakalah bil ujrah contract in the purchase of foreign goods demands clarity of the contract, transparency of ujrah, and adherence to the principles of justice and trust to comply with Islamic law provisions.
